Case Summary:

Our client was injured in a head-on car crash after a distracted driver failed to yield at an intersection. The collision caused a serious injury to his right knee, including a torn meniscus and MCL, which required surgery followed by months of physical therapy. 

At first, the insurance company denied responsibility for the full extent of the injury. They pointed to a prior note in the medical records showing our client had a knee issue months earlier from working out. Based on that, their first offer was only $39,000, which was far below the client’s actual medical bills. 

We did a deep review of the client’s medical history and requested earlier imaging of the prior injury. We found significant differences between the workout-related tear and the much more severe injury from the crash. Using these facts and applying the “eggshell skull”, we made it clear that even if a pre-existing condition existed, the crash clearly made it worse, and the at-fault driver was still responsible. 

Thanks to this careful strategy and persistence, we secured a $105,000 settlement before filing a lawsuit. This covered all of our client’s medical and emotional damages.
