Our client went to the emergency room and was admitted overnight for medical care. The next day, after being discharged, she was waiting in the lobby for a ride home when a stranger suddenly assaulted her. The attacker was later arrested, but the incident left our client shaken and seriously hurt. She suffered painful shoulder and chest injuries that required additional medical treatment and added stress during an already difficult time.
The insurance adjuster initially offered $75,000. As we investigated the case, we discovered the hospital had a history of assaults happening on its property. Despite this pattern, there was not enough security in place to protect patients and visitors. We argued that the hospital knew, or should have known, that better security was needed.
The case ultimately settled for $200,000. This result helped our client move forward and reinforced an important message: hospitals and other businesses have a responsibility to keep people safe on their property.
