Our client was crossing the street in the middle of the day to go to the bank. She is an elderly lady and uses an electric wheelchair. She made sure no cars were coming as she crossed the street, but an SUV came out of nowhere and hit her. The accident caused her to break 4 ribs, her collarbone, and suffer a concussion.
She was brought by ambulance to the St. Francis Hospital, where she had to stay for a week. When she filed her claim, the at-fault driver’s insurance initially denied the claim, saying she didn’t have the right-of-way. We argued that if other cars were able to see her and stop, the driver of the SUV should have, as well.
Our attorney pressed on. We presented the details of the accident and how it affected our client’s health. We were able to get the maximum policy limit from the at-fault driver. However, this was not enough to cover our client’s medical bills and other losses.
We then went through her own insurance policy under the underinsured motorist claim. In the end, we secured a $250,000 settlement for our client.
