Case Summary:
Our client’s mother passed away after being injured at a home. The client was involved in an argument at the house of an ex-boyfriend. He pushed her off the front deck of his home. The client sustained an L1-L2 compression fracture and a non-displaced fracture in her wrist. A week later, the client suffered a pulmonary embolism and passed away, after a week in the hospital. The insurance company disputed coverage (classifying the claim as an assault), liability, and relatedness of the pulmonary embolism and subsequent passing of the client due to pre-existing heart issues. After initial denial, we were able to secure a settlement for $300,000 (the policy limit).
