After a serious workplace accident, our client was left dealing with painful injuries and a long recovery. The incident happened when the client was driving a truck loaded with recycling and backing it into a building to be weighed. As the truck was positioned near the weighing area, a large door suddenly fell onto the vehicle. The client had to crawl across the seats just to get out of the truck safely.
The accident caused multiple injuries, including trauma to the head, neck, and back. The client also developed post-concussion syndrome, ongoing headaches, vision problems, and injuries to both shoulders and the left arm. These injuries required extensive medical treatment and ongoing care.
Because the case was handled through workers’ compensation, fault was not the central issue. However, the case still involved significant work to review medical records, calculate the long-term impact of the injuries, and determine the cost of future medical care. The insurance company took additional time to review the claim due to the large amount of medical documentation and the need to establish a Medicare Set-Aside for future treatment. Through extended mediation, the parties were ultimately able to reach an agreement.
The case was successfully resolved through a pre-litigation settlement totaling $211,843.06, along with $223,811.00 set aside for future medical care through a Medicare Set-Aside arrangement. This resolution helped ensure the client’s anticipated medical needs would be covered moving forward.
