A delivery driver was injured while dropping off a package at a home in Lawrence, Kansas, during icy winter conditions. The driveway was covered in ice, so he carefully walked through the grass to avoid slipping. After delivering the package, he stepped onto the front porch and stairs, which did not appear icy but had not been treated with salt or ice melt. As he stepped down, he slipped on hidden ice and fell hard.
A neighbor across the street witnessed the aftermath of the fall and came over to help. The neighbor also confirmed that the porch and steps were icy at the time. Although the homeowners were not there, it was argued that they should have known a package delivery was expected that day and taken reasonable steps to clear the ice and make the property safer for visitors and delivery drivers.
The fall caused a fractured ankle that required four surgeries and a long recovery process.
