Our client was injured in a crash near Madison Avenue and West 44th Street in Kansas City, Missouri. He was driving straight when another driver backed up and struck the side of his vehicle. The collision caused injuries to his neck, back, hands, chest, and head.
Before the crash, our client already used a wheelchair, but he had ways to stay active and manage everyday life. After the accident, even simple tasks became much harder, and he lost much of the independence he had worked to maintain. His wife wrote a powerful victim impact statement about how the crash changed their daily routine and created new challenges at home.
The insurance company argued that his pain and limitations were not caused by the crash and were only related to his age and pre-existing condition. To fight back, we provided clear evidence, including a video showing how much more difficult it had become for him to get in and out of his handicap-accessible truck after the collision.
The insurer first offered just $45,300. We continued pushing for full compensation and secured the available $100,000 from the at-fault driver’s policy, plus an additional $25,000 through our client’s underinsured motorist coverage. We also recovered $32,500 for his wife, who suffered minor injuries in the crash, more than double the original offer made for her claim.
