Our clients, a family consisting of a mother, father, and daughter, had the right-of-way when a delivery truck for an online retailer cut in front of them. The mother, who was driving the car, tried to avoid the truck but was unable to.
She hit the side of the delivery truck and then crashed into a brick wall. The family all suffered various injuries. They were taken to the ER, where they underwent extensive medical examinations. The mother needed 2 surgeries, one for her neck and one for her lumbar.
The father needed to have back surgery. Their daughter, luckily, didn’t sustain many physical injuries; however, she now has trauma from riding in the car and needs to see a therapist.
The driver of the delivery truck was an independent contractor hired by the online retailer. Since the delivery driver was not a direct employee of the online retailer, we had to seek compensation through the third-party’s insurance.
The initial offer was $295,000. The insurance company undervalued the family’s injuries, so we pressed to get full policy coverage. After months of pressure, we were able to secure a $1,000,000 settlement. This was enough to pay for all medical treatments, including the daughter’s therapy, property damage, and the time they needed to take off work.
