A Lawrence man was asleep in his apartment when part of the ceiling suddenly collapsed on top of him. The apartment complex knew there was a construction defect before the collapse and had already completed ceiling repairs in other units. However, the problem in our client’s apartment was not repaired, and he was never warned about the danger.
The collapse left our client with a traumatic brain injury and concussion, along with cuts and bruises to his back, hip, right leg, and shoulder. He also suffered a herniated disc in his lower back and a partial tear in his right shoulder.
“No person should feel unsafe in their own home. Negligent property owners deserve the full consequences of their actions,” said the case’s lead attorney Oscar Espinoza.
We investigated the collapse, located witnesses, and worked with experts who could explain why the ceiling failed and how the accident caused our client’s injuries. We then negotiated with the apartment complex’s attorneys and insurance companies. Despite receiving no initial settlement offer, we continued building the case and brought it to court. Ultimately, our client received a $390,000 settlement for a premises liability accident in Lawrence for our client.
