Our client was living in a Lee’s Summit duplex that had ongoing maintenance problems. Among the issues, pieces of the popcorn ceiling had begun chipping and falling throughout the home. One night, debris from the ceiling fell onto the stairs. As our client walked down the staircase, she slipped on the debris and tried to grab the handrail for support. Unfortunately, the handrail was also broken and ripped out of the wall, causing her to fall down the stairs.
The fall left our client with a torn meniscus and ACL, along with shoulder and spine injuries. She had previously undergone knee surgery, and her injuries were serious enough that her surgeon had to perform another procedure and replace hardware that had already been placed in her leg.
We built a claim showing how the unsafe conditions and lack of proper maintenance contributed to her fall and injuries. We demanded the full $300,000 insurance policy limits. Just six days after receiving our demand, the insurance company agreed to pay the full policy limits, resulting in a $300,000 Lee’s Summit premises liability settlement for our client.
