A U.S. Postal Service worker was making a routine delivery when a dog suddenly jumped over a fence and charged toward him. Startled, he fell and suffered a serious wrist injury that eventually required surgery.
The insurance company initially offered $95,000 to settle the case and argued there were serious liability and coverage concerns. However, our KC dog attack attorney dug deeper and found a previous court case with very similar circumstances involving a child who was injured after being frightened by a dog. By using that case law and applying our legal knowledge, we were able to strengthen the argument that the homeowner could still be held responsible, even though the dog never physically attacked the victim.
As the case progressed, that strategy made a major impact on negotiations. The case ultimately settled for $160,000, helping our client recover compensation for his injury, surgery, and the challenges he faced after the fall. This result shows how important it can be to have an attorney who understands the law and knows how to use past cases to fight for injured people.
