What Benefits Can I Receive in a Worker’s Comp Claim?

In Oklahoma, you have 30 days to report the workplace injury to your employer. Workers’ compensation is implemented to protect workers and their families against hardships that come from work-related accidents.

Oklahoma workers’ comp benefits are provided “without regard to fault," which means it doesn’t matter who caused the workplace injury or illness. That means you can file a claim even if you are at fault. Employees can still get workers’ compensation benefits as long as the injury is work-related.

By hiring a Tulsa worker’s comp attorney, you can seek compensation to cover:

  • Medical treatment
  • Lost wages
  • Permanent disabilities
  • Job training for new work
  • Vocational rehabilitation
  • Reimbursement for wrongful death, including funeral expenses

Understanding Workplace Disability in Oklahoma

Depending on the severity of your injuries, you may need temporary or total disability or permanent partial disability.

Temporary or Total Disability

Your doctor will first assess your condition and recommend treatment. They may put you on work restrictions or take you off work completely. If you’re on restricted duty and your employer can’t accommodate you, they may send you home and pay 75% of your salary up to a limit.

If you’re on total disability, you can’t work until treatment is complete, and workers’ comp insurance will pay your benefits.

Permanent Partial Disability

Once your treatment is complete, your doctor will release you at Maximum Medical Improvement (MMI). At this point, your doctor will assign a disability rating, which measures the percentage of permanent partial disability. Your Tulsa disability attorney can also arrange an independent rating by a separate doctor.

Disability ratings often vary significantly between doctors. To maximize compensation, your attorney will present the highest rating to the judge. Using an independent doctor ensures a fair assessment of your disability, helping you secure a more accurate rating and better compensation.
