Our client was working at a gas station in Kansas City when an act of violence changed his life. While on the job, he was shot in the face by an individual, who was not an employee, who had been left in charge of the store while the owner stepped away. The shooting caused serious injuries, including significant memory loss and PTSD.
This case presented unique legal challenges because it was not a typical workplace injury claim. After thoroughly investigating the circumstances, we gathered evidence showing that the store owner's actions may have contributed to what happened. Building a strong case required uncovering facts that connected the owner's decisions to the events that led to the shooting.
As a result of our efforts, we secured a total settlement of $120,000 for our client. This included the tender of the franchise owner's homeowner's policy limits, along with additional contributions from the owner and the business insurer.
We also successfully negotiated a substantial reduction of the workers' compensation lien, lowering it from more than $110,000 to just $25,000. This helped our client keep significantly more of his recovery as he continued to move forward after a devastating and life-altering incident.
