Our client was a passenger in a car traveling through an intersection in Lenexa, Kansas, when a drunk driver sped through a red light and T-boned the vehicle on the passenger side.
The crash caused catastrophic injuries. Our client was placed on life support in the ICU, suffered broken ribs, required a tracheostomy, and was left paralyzed. She later entered a rehabilitation facility and is not expected to walk again.
Despite evidence that the other driver was drunk, speeding, and ran the red light, the insurance company tried to place some of the blame on our client’s husband, who had been driving their vehicle and had alcohol in his system at the time of the crash. The at-fault driver also had a history of drunk driving and a previous drunk-driving crash and was ultimately sent to prison.
The available policy limit was initially just $50,000. We continued investigating how the insurance company handled the claim and pursued a bad-faith claim against the insurer.
“We exposed the institutional bad faith that is built into the practices in insurance companies,” said lead attorney Dave Johnson. Through mediation, we secured an additional $250,000 from the insurance company, bringing our client’s total settlement to $300,000.
