First, it is important to note that Missouri is not a one-bite state. In such states, like Kansas, dogs are allowed one free bite: If it is their first time biting or attacking someone, they are let off with a warning.
Fortunately, Missouri law considers dog owners “strictly liable” for their pets. That means that you do not have to consider whether the dog has bitten someone before, or even showed violent tendencies. What’s more, you do not need to prove that the dog owner was negligent.
A strong dog bite claim will only need to prove the following:
- The victim did not provoke the dog;
- The victim was a lawful visitor or guest on a public or private property; and
- The bite resulted in a documented injury and damages.
