We represented a parent of one of the deceased parents, as well as their 4-year-old son, who suffered severe injuries. A father, a mother, and their son were driving on the road when they were struck head-on by a car that swerved into their lane. The driver of the car claimed that they swerved because a commercial vehicle was partially sitting in the shoulder of the road, and the driver opened his door.
We then learned that the driver, who was partially pulled over in the shoulder, was in his work vehicle but was helping his girlfriend, who was having car troubles.
This caused our wrongful death and car accident attorneys to do some deep digging to discover who was truly at fault for the death of the parents and the injuries of the 4-year-old boy.
We hired a human factors engineer who testified on the reception and visibility of the commercial vehicle and how much reaction time the other driver had to notice the open door. Along with this, we also hired an economist to calculate on the amount of wages the parents lost because of their deaths. In the end, we were able to secure a $1,225,000 settlement with contributions from the driver that hit our clients, the corporation driver of the pulled-over vehicle worked for, and his girlfriend’s insurance.
