A deposition is a sworn testimony taken outside of the courtroom. You're under oath, just as you would be at trial. But you're usually in a conference room. Typically, you, your attorney, the defense attorney, and a court reporter who transcribes everything that is said are present for the deposition. The defense attorney will ask you questions, and your attorney is there to object when appropriate to protect you. The defense attorney will ask about you, your background, your medical history, the accident itself, your injuries, and what treatments you've received. The defense attorney needs your account of the accident, but is also looking for any discrepancies between your deposition testimony, your medical records, prior statements, social media posts that contradict your injury claims, gaps or changes in your medical history, or other things that can be misconstrued or used against you. You should answer only what is being asked and always tell the truth.
