What Should I Say – And Not Say – To the Insurance Adjuster?

First, you should know that you have a contractual duty to cooperate with your own insurance under your own policy. However, you do not have this duty to the at-fault driver's insurance. The at-fault driver's adjuster's goal is to minimize what their company pays you, and they will try to lock you into a story by having you give a recorded statement of your account of the accident. This allows them to minimize your injury claims or shift fault to you instead of giving a recorded statement. Have them speak to your attorney. Once you're represented by an attorney, they are not allowed to contact you. Anything you say in a recorded statement may be used against you and allows the outfall insurance to build their argument and minimize your accident.
