Medical malpractice cases are complex. They require extensive investigation, expert testimony, and aggressive legal strategy. Our firm has a large team of attorneys and support staff dedicated to handling every aspect of your case, from gathering medical records to negotiating with insurance companies to presenting your case in court if necessary.

What Is Medical Malpractice?

Medical malpractice happens when a doctor, nurse, hospital, or other healthcare provider fails to provide proper care, and that failure causes you harm. Under Neb. Rev. Stat. § 44-2810, healthcare providers must use the same level of care, skill, and knowledge that other providers in similar communities would use in the same situation.

When they fail to meet this standard, and you get hurt as a result, they can be held legally responsible.

Common Examples of Medical Malpractice in Nebraska

Medical mistakes can happen in many ways. It can be hard to determine if the result was simply an “unsuccessful attempt at treatment” or true malpractice. That’s why it’s important to speak with an Omaha medical malpractice lawyer who has the resources and team to investigate your case thoroughly.

Some of the most common cases DM Injury Law handles include:

  • Misdiagnosis or Delayed Diagnosis: When a doctor fails to identify a serious condition like cancer, heart disease, or stroke in time for proper treatment.
  • Surgical Errors: Mistakes during surgery, such as operating on the wrong body part, leaving surgical tools inside the patient, or damaging organs.
  • Medication Errors: Prescribing the wrong medication, incorrect dosage, or failing to check for dangerous drug interactions.
  • Birth Injuries: Harm to a mother or baby during pregnancy, labor, or delivery due to negligent care.
  • Anesthesia Mistakes: Giving too much or too little anesthesia, or failing to monitor a patient during surgery.
  • Emergency Room Errors: Failing to properly evaluate or treat patients in the ER, leading to worsened conditions or death.
  • Hospital Negligence: Infections from unsanitary conditions, falls, bedsores, or failure to monitor patients properly.

If you or a loved one suffered serious injury requiring medical treatment or a hospital visit due to a healthcare provider’s actions, you may have a medical malpractice case. Speak to our lawyers today for a FREE case review.

How Long Do I Have to File a Nebraska Medical Malpractice Claim?

Nebraska law sets strict deadlines for filing medical malpractice claims. Under Nebraska Revised Statute § 44-2828, you generally have two years from the date of the medical error to file a lawsuit.

However, if you didn’t discover the injury right away, and couldn’t have reasonably discovered it, you may have one year from the date you discovered the harm to file your case.

Important: No matter when you discover the injury, Nebraska law does not allow medical malpractice lawsuits to be filed more than 10 years after the date of the medical error

Because of these strict deadlines, it’s critical to contact a medical malpractice attorney in Omaha as soon as possible. Waiting too long could mean losing your right to compensation forever.

Compensation You Can Recover in Nebraska Medical Malpractice Claims

If you’ve been harmed by medical negligence, you may be entitled to compensation for:

  • Past and Future Medical Expenses: – Past and Future Medical Expenses: This covers costs for medical treatments you have already received and any future medical care required due to the injury.
  • Lost Wages and Loss of Earning Capacity: This provides compensation for income lost during recovery and any reduced ability to earn in the future.
  • Physical Pain and Suffering: This is reimbursement for the physical discomfort caused by your injury.
  • Emotional Distress: These are damages awarded for the psychological impact, such as anxiety or depression, resulting from the incident.
  • Permanent Disability or Disfigurement: This is compensation for long-term physical impairments or visible scars caused by the injury.
  • Loss of Quality of Life: These are damages for the reduced enjoyment or ability to participate in everyday activities.
  • Wrongful Death: In cases of wrongful death, family members may recover compensation for funeral expenses, loss of financial support, and loss of companionship.

Our Omaha med mal lawyer will calculate the full extent of your losses, including future losses that the insurance company will refuse to consider. Our goal is to secure the maximum settlement possible for you.

Omaha Medical Malpractice Claims FAQs

How do I know if I have an Omaha medical malpractice case?

Not every bad medical outcome is malpractice. To have a valid case, you must prove that:

  1. You had a doctor-patient relationship with the healthcare provider
  1. The provider failed to meet the accepted standard of care
  1. This failure directly caused your injury
  1. You suffered damages (medical bills, lost wages, pain and suffering, etc.)

Our team can review your case for free and tell you whether you have grounds to pursue a claim.

How long does a medical malpractice case take?

Every case is different. Some cases settle in a few months, while others may take a year or more, especially if they go to trial. Medical malpractice cases require careful investigation and expert testimony, which takes time. However, we move as quickly as possible while building the strongest case for you.

What if I signed a consent form before my treatment?

Signing a consent form does not protect a doctor or hospital from liability if they were negligent. Consent forms typically state that you understand the risks of a procedure, but they do not give healthcare providers permission to make careless mistakes.

Can I afford to hire a lawyer?

Yes, YOU PAY NOTHING out of pocket. Our Omaha medical malpractice attorney services are provided on a contingency fee basis. You pay nothing upfront, and we only collect a fee if we win your case. If we don’t recover compensation for you, you owe us nothing.

What if my loved one died due to medical negligence?

If a family member died because of a medical error, you may be able to file a wrongful death claim. Eligible family members typically include spouses, children, and parents. These claims can recover compensation for funeral costs, loss of financial support, and the emotional loss of your loved one.

  • I Knew from Our Very First Phone Call that I Was in Good Hands!

We recently had a serious accident in our family, and I admittedly felt very lost trying to figure out next steps. A friend strongly recommended Aaron LaPlant, and I knew from our very first phone call that I was in good hands. Aaron explained everything, from start to finish, in a way that helped me understand the law, my rights, and my choices. He was always patient, and showed genuine interest in ensuring I was comfortable and in charge of the process. It would be obvious to anyone that Aaron is an expert in his field, and I cannot possibly recommend him enough. Getting injured can be very traumatic, and the last thing anyone needs is additional stress through a litigation process. Aaron made us feel safe, and that’s irreplaceable.
